Acquisition Financing Issues Program at Commercial Finance Asssociation Annual Convention

On November 15, 2013, Otterbourg partner, David Morse, moderated and participated in a panel titled Issues for ABL Commitment Letters in Acquisition Financing:  Be Careful What You Wish For! at the 69th Annual Convention of the Commercial Finance Association held in Los Angeles on November 13 through November 15, 2013.  The panel was sponsored by the Commercial Finance Committee and the Business Law Section of the American Bar Association.

Topics covered included "SunGard", MAC conditions, Xerox provisions, diligence conditions, solvency conditions, the use of flex and the impact of the syndication process in putting together the commitment letter for a transaction. 

Other panelists included Bobbi Acord Noland and Hamid R. Namazie.
