Program on Critical Vendor and Trade Supply Agreements

On November 9, 2015, Scott L. Hazan, a member of the firm of Otterbourg P.C., gave a presentation to the membership of F&D on opportunities for vendors to participate in critical vendor programs when a customer files Chapter 11 under the U.S. Bankruptcy Code. Topics discussed included:
- a form of Trade Credit Agreement
- the risks and rewards of participating in the program
- the Impact, if any, on exposure to preference actions
