Program on Critical Vendor and Trade Supply Agreements

On November 9, 2015, Scott L. Hazan, a member of the firm of Otterbourg P.C., gave a presentation to the membership of F&D on opportunities for vendors to participate in critical vendor programs when a customer files Chapter 11 under the U.S. Bankruptcy Code.  Topics discussed included:

  • a form of Trade Credit Agreement
  • the risks and rewards of participating in the program
  • the Impact, if any, on exposure to preference actions

F&D Reports is a privately held industry specific credit consulting organization which monitors public and private retailers in all industries including restaurants, convenience stores, drug/pharmaceutical, fruit service, grocery and mass merchandise.  Its membership/subscribership includes Fortune 500 firms.
