William O'Neill Regional Bankruptcy Institute: Program on Section 546 of Bankruptcy Code

At the annual William O'Neill Regional Bankruptcy Institute Conference held on May 17, 2012 at the Wyndham Hotel in Cleveland, Ohio, Otterbourg partner, Scott Hazan, participated in a panel on "Section 546(e): A Very Crowded Safe Harbor." The panel discussed the recent decisions of the courts adopting a broad interpretation of this provision of the US Bankruptcy Code to protect participants in transactions involving settlement payments or securities contracts from claims of fraudulent transfers. Other panelists included Bankruptcy Judge Robert Drain of the Southern District of New York.
