Sunni Beville Quoted in The Deal on Brazilian Telecom Provider’s Chapter 11 Filing

The Deal has quoted Otterbourg partner Sunni Beville in the article “Oi Plots Novel Chapter 11 Maneuver.”
Oi SA, a Brazilian telecom company, is exploring a Chapter 11 strategy, potentially re-structuring its liabilities in ways that could blur traditional distinctions between debt classes. In doing so, the article says, the company may be positioning itself to reshape how value is allocated among creditors and stakeholders in its restructuring.
If Oi does enter Chapter 11, Beville said it would “create a level of uncertainty in finality questions for creditors,” which could then “affect the pricing of loans on the secondary market where [debt] could be worth something different if there’s another filing.”
Chapter 15 bankruptcy protection, Beville adds, “was designed for this very circumstance: There’s a proceeding in another country and the U.S. Bankruptcy Court is permitted to coordinate and ensure they’re in compliance with a foreign proceeding, especially in a case like this where the U.S. assets are limited.”
