David Morse Moderates Joint ACFA/SFNet Panel on Lending on Assets in Mexico

Otterbourg partner David Morse moderated the panel “Lending on Assets in Mexico: State of the Art 2025!” on March 25, 2025, held at the New York City Bar.  The program was sponsored by the Association of Commercial Finance Attorneys, the New York and New Jersey Chapters of the Secured Finance Network, and Otterbourg.

Morse was joined by Chris Fulman from FGI Finance, Samuel Suchowiecky from Hilco Global Mexico and Javier Arreola of the firm of Nader Hayaux & Goebel. In a lively and informative discussion, the panel provided real life, current perspectives on how secured lenders may structure credit facilities, and the steps the secured lender can take, whether lending to a U.S. company with assets in Mexico or to a Mexican company, so as to reduce risks and maximize recoveries, covering both legal and practical considerations. The panel set out the strategies for the secured lender to be able to rely on assets in Mexico in making loans available to its borrowers with assets there.

Morse is currently chair of Otterbourg’s international finance practice group.
