Otterbourg member Adam Silverstein has been shortlisted for the Financial Times Innovative Lawyers North America awards. A commercial litigator for over 30 years, Adam was named a finalist in the category of “Innovative Practitioner.”

Adam was recognized for his work serving in leadership roles in two of the largest mass tort bankruptcy cases ever filed, combatting corporations using strategies such as the “Texas Two-Step” to manipulate the bankruptcy code to manage their tort liability. Adam co-led the multi-firm trial team on behalf of the Official Committee of Combat Arms Earplug Claimants that won dismissal of the Aearo Technologies, LLC (3M) bankruptcy in June 2023. Earlier in the case, he co-led the effort by veterans and service members who had sued 3M for defective earplugs to defeat the attempt by 3M to stay their multi-district litigation based on the bankruptcy filing. Adam also was one of the lead trial lawyers who obtained dismissal of the LTL Management, LLC (J&J) bankruptcy on behalf of the Official Committee of Tort Claimants in July of this year, after he contributed to the appellate effort to dismiss the first LTL bankruptcy in January. The Aearo and LTL dismissals were the first dismissals of mass tort bankruptcies in history.

The Innovative Lawyers awards highlight the law firms, in-house teams and individuals bringing innovation to the practice of law. Award winners will be announced at a reception in New York on December 4. The full FT shortlist is linked here.
